Change in Packages and Pricing :

Dial4Web retains the authority to modify the pricing and provisions of its services and packages at any given moment. Any escalation in service charges is at the discretion of our organization, and for all fresh agreements, the revised pricing shall apply. While Dial4Web reserves the right to adjust prices at any time, the new pricing structure will be enforced for new agreements, while orders placed prior to the announcement of the revised prices will be honored at the previous rates.

Account Setup: Your account will be established once payment is received and confirmed by Dial4Web upon completion of the screening process. It is incumbent upon you to furnish accurate information for verification purposes; failure to do so may result in a delay in the creation of your account.

Late / Non-Payment :

• In the event of reactivation of previously cancelled accounts, an administrative fee of Rs. 5000 will be levied.
• Should your account become overdue by 7 days, all technical support will be suspended.
• If your account remains overdue by 14 days, your website and other associated services will be suspended.
• Should your account remain overdue by 30 days, all data and websites will be permanently deleted from our systems.
• In the event of a credit card chargeback or transaction reversal, your account will be terminated, and all associated websites, data, emails, and details will be promptly erased.
• While we will make every effort to contact you through various means, it is ultimately your responsibility as the client to maintain accurate and updated information, including address, contact details, and billing information.
• We rely on the information provided to us at the time of communication. If you fail to receive our notifications due to outdated contact information that you have not updated with our records, we cannot be held responsible. It is entirely the client's responsibility to ensure their information is current. We will not be liable for any consequences resulting from the client's failure to receive or respond to notices sent by Dial4Web

Spam Policy : We maintain a strict zero-tolerance policy towards Unsolicited Commercial Email (UCE) or SPAM on our network. None of our customers or affiliates are authorized to utilize our network for the transmission of Unsolicited Commercial Email. Resellers of Dial4Web are prohibited from hosting, or allowing the hosting of, sites or content that promotes UCE from other networks as well. Violation of this policy may result in severe penalties, including immediate termination of services.

Upon receiving notification of a violation of our spam and UCE policy, we promptly initiate an investigation. During this investigation, we may restrict the client's access to our network. If the violation is confirmed after investigation, we reserve the right to cancel, suspend, or terminate the respective account without prior notice. Additionally, we reserve the right to pursue civil action to recover the costs associated with the investigation. If the violation is determined to be a criminal offense, we may notify law enforcement officials.

Violations of this policy will incur penalties. The first instance of such violation will result in an Administrative Fee of Rs. 5000 and termination of the customer's account. Subsequent violations will incur an Administrative Fee of Rs. 7500 and immediate termination of the customer's account. We strictly prohibit spamming, so we urge our customers to refrain from engaging in such activities.

Our resellers are solely responsible for the actions of their clients on the Dial4Web network. Therefore, we advise our resellers to establish similar policies for their clients. We do not permit mass mailing from our shared servers and do not engage in any dealings with such sites. Sending emails in bulk from your account on the SMTP server is prohibited. We recommend utilizing specialized services from third parties or opting for your own dedicated server.

Proscribed use of services and products :

The method of utilizing our services is entirely at the discretion of the company, and all our clients and affiliates are required to adhere to this decision under any circumstance. Customers are only permitted to utilize Services and Products in a manner that, in the sole judgment of the Company, aligns with the intended purposes of such Services and Products. If a Customer is uncertain whether any proposed use or action is permissible, they are encouraged to contact the Company using the provided contact information. By way of illustration, but not limited to, the following uses of the Services and Products are explicitly prohibited.

• General : illegal Activities: Broadcasting, storing, or circulating any information, data, or material that violates any applicable law or regulation, or that may facilitate such violations, is strictly prohibited. We reserve the right to cooperate with legal authorities or injured parties during investigations into any alleged criminal activity.
• Harm to Others: None of our clients are permitted to use our services or products to cause harm, attempt to cause harm, or engage in any activities related to pornography. Additionally, clients are prohibited from sending out any material, through any means (email, uploading, redistribution, or otherwise), that threatens or promotes physical harm or destruction of property.
• Copyright or Trademark Infringement: Clients are prohibited from using any of our service products to disseminate any material (via email, uploading, posting, or otherwise) that infringes upon any copyright, patent, trademark, trade secret, or other proprietary rights of any third party. This includes, but is not limited to, the unauthorized copying of copyrighted material, digitization and distribution of images or photographs from sources such as magazines, books, or other copyrighted materials, and the unauthorized distribution of copyrighted software. Clients are also prohibited from gathering, or attempting to gather, private information about third parties without their knowledge or written consent. Distribution and/or redistribution of copyrighted material or the aforementioned intrusions will not be tolerated.

Maltreatment Of System And Network :

• System or network security breaches are strictly prohibited and may result in both criminal and civil liability. We reserve the right to pursue criminal charges for any activities aimed at compromising or attempting to compromise network security, including but not limited to the following:
• Introducing malicious programs into our network or any servers owned by us, such as viruses and worms. This also encompasses disruptive activities such as flood pings, port scans, packet spoofing, and the dissemination of forged routing information.
• Engaging in security breaches or disruptions of Internet communication, including accessing data for which the client is not the intended recipient or logging into a server or account without proper authorization.
• Conducting network monitoring that captures data not intended for the client's server.
• Using any program, script, or command to interfere with or disable any terminal or account.
• Establishing a continuous connection on an account provided by the company through artificial means, such as programming or software.
• Attempting to manipulate or alter monitoring, usage reporting, bandwidth tracking, or other operational functions of the company, including tampering with log files.
• Engaging in any actions that the company deems detrimental to its operations or reputation.
• Committing any acts that the company considers an unacceptable use of resources, business practices, or otherwise intolerable.
• Any violations of these policies may result in severe penalties, including immediate termination of services and legal action.

Proscribed Scripts And Programs :

There are established standard regulations that apply to all scripts. Please read the following rules carefully:

The duration of script execution on the processor should not exceed a few seconds; otherwise, it will be removed.

Scripts are prohibited from utilizing large amounts of system resources. If a script consumes excessive RAM or processor resources, the account will be immediately suspended pending a resolution.

Similarly, if a site is found to be using 10% or more of system resources, it will be promptly suspended until a substitute solution is implemented.

Referral or external sites are not permitted to utilize any scripts.

Dial4Web servers do not permit the use of scripts that:

Interact with hardware.

Interact with or alter server configuration files.

• Any script that utilizes and processes a massive number of flatfiles or large flatfile databases.

LOSS OF BACKUP AND DATA :

Your utilization of our services is undertaken at your sole risk. Dial4Web bears no responsibility for any data and/or files stored on your account. By using our services, you agree to take responsibility for data transfer, files, and the maintenance of proper backups for the data and files hosted on our server. We reserve the right to take weekly backups of data that have been modified or are new, which serve the purpose of server restoration.

Mailing List Hosting: We do not support the hosting of mailing lists on our servers. Any mailing lists discovered on our servers will be terminated without prior notice. Pornography or any other sexually explicit content marketing is strictly prohibited on any of the servers operated by Dial4Web. This includes any websites containing sexual content or links to adult content elsewhere. The same policy applies to sites promoting illicit activities or posing a threat to the servers of Dial4Web or any other internet servers. Links to such materials are also prohibited.

What do you own and What Not: Source Code/Database of Website :

Clients receive complimentary web hosting with their package if specified in the email/proposal provided by our sales team. However, they do not own it.

• Content Management System (CMS): Clients do not own the CMS, which is a web application used to manage website content administration. The CMS, along with all software, is owned by Dial4Web, and clients can use it as long as they operate their website on our server.
• Database Software: Clients do not own the database software, such as MySql, created by Dial4Web. Clients own their website data and content stored in the database if they have created it.
• Source Code (other custom programming): Clients do not own the source code created in the language of the Web Server Platform, which contains the logic and connectors to other software running on the server. The source code generates HTML/CSS/Javascript for the browser to render on the screen.
• HTML/CSS/Javascript: Clients own the HTML/CSS/Javascript upon completion and final payment of the project. HTML and CSS are the building blocks of websites, while Javascript can alter HTML and CSS as users interact with the website.
• Visual Design: Clients own the visual design, which includes layout and graphical assets like colors, photography, and typography, upon completion and final payment of the project.
• Text Content: Clients own the text content of their website if they or their employee authors it.
• Photography: Clients own the website photography if they or their employee takes the pictures.
• Domain Name: Clients do not own the domain name, but rather have a contract with the domain registrar for its exclusive use.
• The Legal Reality of Owning a Website: Clients do not legally own the domain name, web server platform, CMS, web platform, database software, or language used to build their website. Dial4Web grants a license to use the Intellectual Property of the website created by them. Clients only own the "Finished Assembled Work," including HTML/CSS/Javascript, visual design, and text content upon completion and final payment of the project.
• Conclusion: If a client wants the source code of the website, Dial4Web will not share its CMS technology, databases, or web hosting details. Clients own the right to HTML/CSS/Javascript, visual design, and text content upon completion and final payment of the project.
• Web Hosting Details: Dial4Web will not share web hosting credentials with clients to protect the technology of the website and maintain server security. Clients are not allowed to install any open source or third-party software/plugins/modules/components/CMS like WordPress, Joomla, Drupal, Magento, or Shopify.
• Domain Details: Dial4Web will not share domain credentials with clients as long as they continue to run the website with us. However, if clients request domain control panel access, it will be provided with a written email acknowledging their sole responsibility for any issues that may arise.
• Working on Client’s Server: Web applications/websites/portals designed and developed by Dial4Web are not hosted on the client's server.

Support for issues related to the control panel will be provided with certain limitations, including basic functions such as adding or deleting accounts, DNS management, and password changes. Limited support will also be offered for third-party software like PHP-Nuke, Advanced Guest Book, phpBB, osCommerce, etc.

Dial4Web will not accommodate the inclusion of free add-on scripts in the control panel. Matters concerning software errors or bugs that arise as a result of third-party involvement must be reported directly to the software vendors for support.

Web development, third-party scripts and software installation, maintenance, compatibility, and day-to-day administration tasks such as managing email accounts and domains are not within the scope of support provided by Dial4Web. However, initial custom configuration or setup of the server, including email accounts, domains, user establishment, and software adjustments, may be assisted by Dial4Web at their discretion without additional charges. This may include SSL certificate installation, clientexec setup, etc.

Installation of 3rd Party software :

Users are fully responsible for any third-party software installed on their web space. If any security breaches or unusual activities occur due to the installation of such software, the account may be terminated without prior notice.

Specifications and Limitations of Responsibilities:

• Dial4Web shall not be held responsible for any damages, including consequential damages, resulting from the unavailability or offline status of our servers.
• Dial4Web is not liable for any claims for compensation, including incidental or consequential compensation, arising from the corruption or removal of any website from our servers.

In cases where damage occurs, immediate termination of services may be the final or maximum limitation of liability.

Web Server: Clients get web hosting complimentary with the package, if stated in the email/proposal offered by our sales team. Thus, they don't own it.

Content Management System (CMS): Clients Don’t Own This. A Web Application that is used to manage the administration of content for your website. The CMS (and all software) is owned by the creators i.e. Dial4Web Pvt. Ltd. and you use it as long as you run this website on our server.

Database Software: Clients Don’t Own This. Clients don't have to write on the Database Software such as MySql created by Dial4Web Pvt. Ltd.. Clients own their website data and content stored in the database if they have written it.

Source Code (other custom programming): Clients Don’t Own This. The programmed code created in the language of the Web Server Platform that contains the logic and connectors to other software running on the server. Source code may also communicate with outside integrated system servers. The source code will generate the HTML/CSS/Javascript for the browser to render to your screen.

HTML/CSS/Javascript: Clients Own This. HTML and CSS are the building blocks of almost all websites. It is a language that browsers understand. Javascript is programming that may alter the HTML and CSS as one interacts with the website. Dial4Web Pvt. Ltd. provides an agreement giving HTML/CSS/Javascript ownership to you upon completion and final payment of the project.

Visual Design: Clients Own This. The combination of layout and presentable graphical assets like colors, photography and typography to create the user interface, images and videos, and readable content of the website. The HTML/CSS/Javascript will contain the information to display these assets so the browser can render the website on your screen. Dial4Web Pvt. Ltd. provides an agreement to clients giving website visual design ownership to you upon completion and final payment of the project.

Text Content: Clients Own This. The formatted, readable, search engine indexable, copy and pastable website text that is rendered in the browser. Client will own his/her website text content if they or their employee authors the content.

Photography: Clients Own This… If they Took The Pictures. The entire or part of a digitized photograph used on a website as either part of the logo, user interface, slideshow, gallery, video or other visual design asset. Client will own their website photography if they or their employee captures the photographs

Domain Name: You Don’t Own This Either.  The Domain Name appears in the address bar of the browser. It is the humanly memorable, identifiable part of the website URL that is indexed by search engines, displayed in most marketing, and remembered as part of the brand. Clients do not actually own a domain name even though they are a registered domain owner. They have a contract with the domain registrar giving them “ownership” of the domain much like a contract with a telephone company for a phone number. Domain name registration with a registrar does not confer any legal ownership of the domain name, only an exclusive right of use.

The Legal Reality of Owning a Website : Clients will never legally own the domain name, web server platform, CMS, web platform, database software, or language used to build your website. Dial4Web Pvt. Ltd. only grants a license to use the Intellectual Property of the website created by Dial4Web Pvt. Ltd. using its own customized code to build it. Only if a client programs the website himself/herself or has a “work for hire” agreement, he/she will own the website source code. If the client authors his/her own content, designs the interface, takes his/her own photographs, and creates his/her own graphics, he/she will own all of the website “visual design” and content. Actually, clients only own the "Finished Assembled Work" i.e. HTML/CSS/Javascript, visual design, and the text content upon completion and final payment of the project.

Conclusion: If a client wants the source code of the website, Dial4Web Pvt. Ltd. will not share its CMS technology, Databases, Location wise Sub-domains or Sub-directory web pages or Web Hosting Details of the website. Back-End of our Template based as well as Customized Website (Admin Panel/CMS) + Location Wise (Sub-domain) Web Pages developed by Dial4Web Pvt. Ltd.Team is the result of huge research, innovative ideas and years of hard work by Dial4Web Pvt. Ltd.. Dial4Web holds rights to its technology and at any point of time, if the client wishes to discontinue services with Dial4Web Pvt. Ltd., the client can take control of the domain name (if purchased by Dial4Web Pvt. Ltd.) after paying all due payment (if any). Dial4Web Pvt. Ltd. will not share its source code / backup of the website which includes its Admin Panel/CMS, Database mysql files. Client owns the right to get HTML/CSS/Javascript, visual design, and the text content upon completion and final payment of the project.

Web Hosting Details: At any point of time, Dial4Web Pvt. Ltd. will not share Web Hosting Credential with clients to protect website technology of website & maintain security of web server from any malware/viruses. Web Hosting is a free service provided with Website Service to clients. Dial4Web Pvt. Ltd. holds the rights to deny clients from installing any open source or 3rd party software/plugin/module/component/cms like wordpress, joomla, drupal, magento, shopify etc. 

Domain Details: As long as the client continues to run the website with Dial4Web Pvt. Ltd. Dial4Web will not share credentials of the domain purchased by Dial4Web Pvt. Ltd. for the Website of the client. But if the client forces Dial4Web Pvt. Ltd.Team to provide control panel of domain, Dial4Web Pvt. Ltd. will provide the credentials of the domain to the client after getting a written email from client that “If anything bad happens to the structure or promotion of the website, Client will be solely responsible to it. Dial4Web Pvt. Ltd. will not be responsible after providing the credential of the domain.”

Working on Client’s Server: We don’t host web applications / websites / portals designed and developed by Dial4Web Pvt. Ltd. on the client's server
